Terms of Service for Momentum (App) and gluckz.com

1) Eligibility & Age Requirements

You must be at least the age of majority in your jurisdiction to enter into a binding contract. Momentum is designed for Mature 17+ audiences and is not directed to children under 13. By using the services you confirm that you meet these requirements.

2) Description of Services

Momentum provides digital tools to track sobriety streaks, journal reflections, receive reminders, generate share cards, and connect with curated community programming. The Website offers information about Momentum, support resources, and related Gluckz initiatives. Features may evolve over time.

3) Accounts & Access

Momentum does not require a traditional account or cloud sync. When you use optional features that involve authentication, you are responsible for safeguarding any credentials and for all activity that occurs under your access. Do not share access tokens or device unlock methods with others.

4) In-App Purchases & Subscriptions

Momentum+ and other paid features are billed through the app marketplace where you obtained the App (for example, Google Play Billing). Pricing is displayed at purchase. Billing, refunds, and cancellation are handled by the relevant marketplace, subject to its policies. Taxes may apply. Cancelling a subscription ends future charges but does not retroactively refund past payments.

5) Community Guidelines

If you participate in Momentum Circles, live sessions, or other interactive features, you agree to uphold a respectful, non-judgmental environment. You may not harass, threaten, or share content that is hateful, exploitative, or illegal. Gluckz may remove you from a Circle or disable interactive features if behavior violates these guidelines.

6) Acceptable Use

You agree not to misuse Momentum or the Website, including by: attempting to probe, scan, or test system vulnerabilities; deploying automated scripts to harvest data; reverse engineering the App; using Momentum for commercial rehabilitation services without written consent; or infringing on intellectual property rights. Gluckz may investigate and take appropriate action against violations.

7) User Content & Ownership

Your journal entries, streak history, and uploaded photos remain yours. The App stores these locally on your device by default. When you create share cards or participate in community spaces you grant Gluckz a limited, non-exclusive license to display, reproduce, and transmit that content solely to provide the requested feature. You are responsible for ensuring that the content you share does not violate any third-party rights.

8) Intellectual Property

Momentum, the Website, and all associated materials, graphics, and trademarks are owned by Gluckz or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent. All rights not expressly granted are reserved.

9) Feedback

If you submit comments, ideas, or suggestions, you grant Gluckz a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you. Feedback helps us refine Momentum and may be incorporated into future releases.

10) Privacy

Your use of Momentum and the Website is also governed by the Privacy Policy. Please review it to understand how information is collected and used.

11) Wellness & Medical Disclaimer

Momentum provides general wellness tools and is not a substitute for professional medical, psychiatric, or addiction treatment advice. Always seek the guidance of qualified professionals for medical decisions. If you are in crisis, contact local emergency services immediately.

12) Warranty Disclaimer

Momentum and the Website are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Gluckz disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

13) Limitation of Liability

To the maximum extent permitted by law, Gluckz will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising from your use of the services. Gluckz’s aggregate liability for any claim is limited to the greater of the amount you paid for Momentum+ in the twelve months preceding the claim or USD $25.

14) Indemnification

You agree to defend, indemnify, and hold harmless Gluckz, its affiliates, and their respective officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorney fees) arising out of your use of the services, your content, or your violation of these Terms.

15) Suspension & Termination

Gluckz may suspend or terminate access to Momentum or the Website if you violate these Terms, if required by law, or if continuing to provide the services poses risk. You may stop using Momentum at any time by uninstalling the App or discontinuing Website access.

16) Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. If a dispute arises, the parties agree to attempt resolution through informal discussions first. If unresolved, disputes will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to that jurisdiction.

17) Changes to These Terms

We update these Terms frequently to reflect new features, regulatory shifts, and operational needs. When a revision goes live, we refresh the Effective date and publish the latest version at https://gluckz.com/terms. Significant updates may also be communicated in-app or via email when possible.

Please review the Terms before each use of the App or Website and check back regularly so you stay informed. Continuing to access Momentum or gluckz.com after any update confirms your acceptance of the revised Terms; if you disagree with a change, discontinue use until you can review and accept the newest version.
